This website is run by Gohoku, in Honolulu, Hawaiʻi ("we", "us"). By using it, you agree to these terms. If you do not agree, please do not use the site.
These terms
These terms cover this website: its pages, its updates and its forms. How we collect and use information is in our privacy policy, which is part of these terms.
What the site tells you
We work to keep the site accurate, but it describes a product that is still being built. Features change, some are described as in testing, and the roadmap is a plan and not a promise. Screenshots use made-up businesses, names and numbers. Figures about how many calls a server carries are measured in our own tests and depend on the hardware, the network and the calls. Nothing on the site is an offer: prices, and what is included, are set out in a written quote and agreement.
The Kahevo service
Using Kahevo for your business, whether hosted by us or on a server in your office, is covered by a separate written agreement between your business and us, or between your business and the IT company that provides it. If that agreement and these terms disagree, the agreement wins.
Emergency calls
Calling 911 over an internet phone system is not the same as from a traditional phone line. Before relying on any phone system, including Kahevo, please understand its limits:
- Emergency calls need power, a working internet connection and a phone provider that supports them. During a power cut or an internet outage, they may not go through.
- The address sent with an emergency call is the one your phone provider has on file. If you move, or use a phone somewhere else, the right address may not be sent, so tell us or your provider when an address changes.
- Calls from the Kahevo app or from a browser may not send your location at all. Tell the dispatcher where you are.
- Keep another way to reach 911, such as a mobile phone, and make sure everyone who uses your phones knows these limits.
We set up emergency calling with your provider and test it with you before you go live, but we do not run the emergency services and cannot guarantee that an emergency call will connect.
Using the site
Please use the site lawfully. In particular, do not:
- send false information or someone else's details through our forms, or send them in bulk;
- try to break into, overload, or get around the protections of the site or the systems behind it;
- copy the site in bulk with automated tools, except as search engines ordinarily do.
We may block anyone who does, and remove any message or registration.
Who owns what
The site's words, pictures, animations and design, the Kahevo name and the Kahevo hummingbird belong to Gohoku. You may read, print and share pages for your own use and to tell others about Kahevo, but not reuse them in your own product or marketing without our written permission. Other companies' names and marks belong to their owners and are used only to describe what Kahevo works with.
Partner registrations
Registering as a partner, or writing to us as an IT company, does not make you our partner, agent or reseller, and does not let you use the Kahevo name. That happens only when we agree in writing. We may decline or remove a registration at any time.
Other websites
The site links to websites we do not control. We are not responsible for their content or how they handle your information.
No warranty
The site is provided "as is" and "as available". As far as the law allows, we make no promises about it, whether stated or implied, including that it is accurate, complete, always available, free of errors, or fit for a particular purpose.
Limits of liability
As far as the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for lost profits, data or business, arising from your use of the site, even if we were told it might happen. Our total liability for any claim about the site is limited to one hundred US dollars. Nothing in these terms limits a liability that the law does not allow to be limited.
If you use the site in a way that breaks these terms and a claim is brought against us because of it, you agree to cover our reasonable costs of that claim.
Hawaiʻi law
These terms are governed by the laws of the State of Hawaiʻi and the United States, and any dispute about them is for the state or federal courts in Honolulu. If any part of these terms cannot be enforced, the rest still applies.
Changes
We may change these terms by posting a new version here with the date it takes effect. Using the site after that means you accept the new terms.
